Denials/Appeals
DENIALS
Subscribers who maintain their own Compliance Programs on this system are solely responsible for the criteria by which approvals and denials are made for individuals assigned to such programs.
Typically, a denial is triggered when either an individual or organization has failed to meet the requirements of a Compliance Program associated with their Personnel Assignment(s) via the system.
The consequences of receiving a denial are determined by the subscriber that maintains/owns the Compliance Program. Such consequences could include barred access to specific worksites or the subscriber may be restricted from receiving relevant credentialing via the system.
NOTIFICATIONS
Denied Contractors of applicants/employees will be directly informed of the decision by the denying organization. These notifications will be issued in print and electronic forms which are generated by the ERS-CANADA system.
Notifications will include a description of the appeals process available to the applicant/employee. ERS-CANADA will also inform the applicant's employer that credentials have been denied to the applicant and provide appeals guidance to the Employer.
APPEALS
As per most professional standards, denied subscribers have the right to appeal a denial decision. Organizations that deny personnel can address any resulting appeals outside of this system, or they can utilize the internal appeals feature to facilitate the process.
